The Arguments

Oracle’s original allegation was that Google had infringed seven of its patents. This led to a wide debate about the patenting of Application Programming Interfaces (APIs) such as Java. They are designed for common use and should be regarded as such. Google remained adamant that they hadn’t breached any laws as the patent didn’t apply in this case. Moreover, they pointed out serious flaws in the software copyrighting process being followed till now.

The judge had requested both parties to come to an amicable settlement. Both remained stubborn on their viewpoints and refused to budge from their stand. As a result, the lawsuit resulted in a stalemate with no conclusion reached.

The Possible Reasons

There are many reasons that can be given for the failure of the settlement.

Oracle Got the Timing Wrong

Oracle should have proceeded with the lawsuit as soon as it suspected wrongdoing on part of Google. But they didn’t. They got the timing wrong by suing Google after the Android system became successful. Google has earned billions of dollars through royalties from the operating system so far. In this regard, it seems as though Oracle is looking for a piece of the pie rather than protecting the integrity of its API. This is a genuine concern for Google as conceding now would mean a substantial loss of revenue. Obviously Google would prefer a trial over a settlement in order to protect its money.

The Effect on Other Parties

The outcome of the case is not only going to affect Oracle and Google but a number of other parties. These include IT corporations, smartphone brands and internet companies. Moreover, the verdict would also have a direct impact on how software and API copyrighting and patenting is done in the future. The pressure and expectations would have gotten to Oracle and Google.

The Time Already Taken by the Case

If either party chose to settle the case, then it would show that they were in the wrong from the very start. This would mean that there was no reason to drag this case for so long when no decision was possible. The trial is also going to take a couple of months at the very least. Admitting fault at this juncture would have dealt a significant blow to both companies’ reputations.

Lack of Substantial Information

Throughout the case, both defence counsels have been restrictive about letting on information. Even with extensive media coverage, there was little new information that came out in the open during the case. In a nutshell, the case stands at the point it was when Oracle filed the lawsuit. With neither party refusing to submit extensive information, a settlement was simply out of the question. For that, one of the two had to be totally open and honest.

Conclusion

In light of the reasons cited above, it is clear why Oracle and Google failed to reach a settlement in the Android lawsuit. Given the fact that the sales of Android are still strong, it doesn’t appear as if the lawsuit has dented either company’s reputation. However, it does look like Oracle has much to gain in the trial. They don’t stand to lose virtually anything. On the other hand, Google might have to pay royalties and part of the revenue from the Android operating system to Oracle.

That being said, one can only wait for the conclusion of the trial to be certain about which party was in the wrong this whole time.
